Lawsuit Against Kid Rock / Scott Sapp Dismissed

MIAMI - An invasion of privacy lawsuit filed by a woman who claims she participated in a sex video with rock stars Scott Stapp and Kid Rock was dismissed by a judge Wednesday who said the woman cannot sue if she remains anonymous.

Miami-Dade Circuit Judge Gerald Hubbart told a lawyer for the woman, identified only as "Jane Doe" in court papers, that she could refile the lawsuit within 20 days if she is willing to have her real name included.

"There's no showing on why the claim should be allowed to proceed under a fictitious name," Hubbart said at a hearing.

The woman claimed in the lawsuit that she was the "star" of a group of women who appear in the video with Rock and Stapp, the former lead singer of the band Creed. The lawsuit sought to prevent sale of the video and an unspecified amount of damages. It named California-based distributor World Wide Red Light District and Stapp as defendants, but not Rock.

Stapp, who contends the video made in 1999 was stolen, and Rock have won a temporary court order in Michigan preventing World Wide from distributing it or promoting any part of it. Red Light had previously shown a 40-second preview clip on its Web site.

World Wide lawyer Thomas Julin said the woman has no claim because "she's not a child, she's not abused. She can't claim invasion of privacy because this tape was made in the presence of others."

The woman's attorney, Dawn Ausenanger, said her client had been assured the tape - made on a tour bus - would be kept private and that she has already been stigmatized by the notoriety.

"She's not a celebrity. She's not a public figure. She was promised there would never be any intentional commercial use or profit made from the tape," Ausenanger said

DURHAM, N.C. - NBC has obtained exclusive photos that defense lawyers for the Duke University lacrosse players feel will exonerate their clients of rape charges.

Collin Finnerty, 19, and Reade Seligmann, 20, were charged Tuesday with first-degree rape, first-degree sex offense and first-degree kidnapping after a woman said she was raped and beaten at a March 13 lacrosse team party, where she was performing as an exotic dancer.

Dan Abrams, a Duke graduate and former lawyer who now hosts "The Abrams Report" on MSNBC, said he has copies of a series of photos lacrosse team players said they took at the party.

Finnerty appears in none of the photos, Abrams said, which bolsters defense attorneys' claims that the teen wasn't at the party when the alleged rape occurred.

Although Seligmann was in some photos, defense attorneys said the have records from a cab company, ATM receipts and other information with which they can prove he left the party before the alleged rape took place.

The photos help establish a timeline for the events at the party, Abrams said.

Some photos taken before midnight show the players partying before the accuser and another dancer arrived. No photos were taken between 12:10 a.m. and 12:30 a.m., but the dancer is pictured in several shots taken between 12:31 a.m. and 12:41 a.m. in which she was smiling and getting into a car, Abrams said.

"You could argue that something might have happened in that period between 12:10 and 12:30. The defense would say, though, that because she's smiling in the photo taken at 12:31, it would be hard to believe that she had been brutally raped," he said.

Abrams said it was "certainly possible" that the woman had been given a date-rape drug by someone at the party. But he said there has been no evidence to support that claim.

The photos also bolster the defense claims by what they don't show, Abrams said.

Durham County District Attorney Mike Nifong previously said no DNA was found under the accuser's fingernails linking lacrosse players to an attack where she fought back because the attackers were likely wearing long-sleeve shirts or jackets. But Seligmann and most of the players pictured at the party were wearing short sleeves, Abrams said.

Nifong has declined to say what led to the charges or discuss evidence in the case.

Durham police searched two Duke dorm rooms Tuesday night for about two hours, according to resident assistant Taggart White. The contents of the search warrants had not been released by Wednesday evening, so it's unclear what officers were looking for or found.

Nifong said Tuesday that he is still gathering evidence in the case so he can charge a third lacrosse team member.

"I can imagine they never quit investigating, but I think it's unusual to be executing search warrants after they've indicted," defense attorney Bill Cotter said.

Robert Ekstrand, who represents dozens of players on the team, said neither Seligmann nor Finnerty was at the party "at the relevant time." The indictment represents "a horrible circumstance and a product of a rush to judgment," he said.

The case has raised racial tensions and heightened the long-standing town-gown antagonism between Duke students and middle-class, racially mixed Durham. The accuser is black, and all but one of the 47 lacrosse team members are white.

Duke would not comment specifically on any disciplinary action taken against Seligmann and Finnerty, but said it is university practice to suspend students charged with a felony.

Since the scandal broke, the university has canceled the team's season, its coach resigned and Duke officials said they were investigating the behavior of the nationally ranked team, some of whose members have been found guilty of public intoxication and public urination.

Neither Seligmann and Finnerty was among the team members arrested in recent years for such offenses as underage drinking and public urination.

Finnerty, however, was charged in Washington, D.C., with assault after a man told police in November that Finnerty and two friends punched him and called him "gay and other derogatory names." Finnerty agreed to community service.

The above two stories share a common and disturbing trend that seems to be increasing over the past several years. In these cases we have two women who are desperately seeking fame and easy fortune. More and more we hear of people with shady histories accusing famous people of horrible things so they can make a quick buck.

Although we do not know which of the three women in the tape was the “Jane Doe” in the Kid Rock Scott Stapp sex tape, it is not difficult to determine that she is a stripper who is looking for a big financial settlement either in the form of suing both wealthy rockers or getting a percentage of the revenue on the possible sale of the tape.

All of the ladies involved in the tape knew exactly what they were doing and I am sure that they were never forced to have sexual relations with two Big Name superstars of the Rock n Roll world. There were cameras present, and they seemed more than willing to perform oral on both from what I saw. All Rock stars have their choice of about 100 groupies to choose from at any time, they have it thrown in their face every minute of the day.

The recent evidence discovered in the Duke Lacrosse case in my opinion clearly shows that the stripper who made the rape allegations is also desperate for cash and fortune and has affected the lives of two young males, their families and a well respected educational institution.

Unfortunately we see this happening in many cases where women falsely accuse men of rape, particularly with men of power, fame and influence. What these people do not realize is that rarely are they ever successful in their cases and most of all their actions adversely affect those women that are truly raped and taken advantage of. If we look at history most of the women that attempt the dangerous feat of quick fame and fortune usually end up in a far worse position than they were initially.

The wealthy and powerful have the resources to squash these liars, and they will take whatever measures to ensure these people are completely squashed. These folks have many tools available at their disposal and are ruthless when dealing with these cases as their lives and careers depend on it. Those that want to play the game better be prepared for the worst, as their worlds will be turned upside down. Their 15 minutes of fame often cause them to lose everything they have.

There are many cases where the guilty have managed to get off simply because of the tactics they employ, there are countless stories of stars hiring specialized people to dig up dirt on the accuser, scare and threaten, or even go so far as to murder them.

What disturbs me most is that these lowlife false accusers make the true rape and abuse cases much more difficult to prosecute and prove. Often, the victims are afraid to even report the cases because of the potential dangers they will face, and false accusers are partly to blame for this.

In the Duke case, I strongly feel that the accuser – if proven she lied – should face a prison term of at least 10 years. We need to send a message loud and clear to these type of people and this must stop in order to make prosecuting legitimate cases easier and I hope that she and others like her suffer so that others will think twice.

One message that should be loud and clear to EVERYONE, famous or not, is that they should be careful what they do in their lives and who they get involved with. People should use common sense and be wary of their actions, particularly with those in shady professions. If you think it cannot happen to you, read the stories above and think again because it definitely can and unfortunately if it does, it could lead to a tumultuous time in your life with some long term damaging ramifications.
